Policies & Procedures PAYMENTS We accept payment three ways. Cash, Square, and PayPal. No checks. HOLDS At K's Kustom's we sell on a first come first serve basis. In order to hold a unit, we require a non-refundable deposit of 50% of the cost of the ride-on which can be paid via PayPal or in person. The non-refundable deposit holds the unit for 3 days, otherwise a $10 a day storage fee will be applied for every unit being held. The deposit is put towards the purchase price of the ride-on(s) that was(were) chosen by the customer and agreed upon with either Josh or Rachel of K's Kustom's only. If upon arrival you wish to purchase another ride-on our lot, instead of the one(s) the deposit was placed, you may transfer the deposit to the new choice. The deposit is transferable to another ride-on if you decide on a different unit upon pick up. After ten days, if the ride-on has not been picked up, the customer has forfeited their deposit and the unit goes back up for sale and K's Kustom's keeps the deposit. We will make several recorded attempts, via email or text, to reach you to resolve the matter. K'S KUSTOM'S POLICES All sales are final. We offer a First Responded/Military/Senior Discount of 10% off the purchase of a ride-on only. Can not be combined with any other discount or sale. Can not be used on any other service we offer or on purchases of parts and batteries. We do take certain trade-ins towards the purchase of ride-on's. Brand, model and condition apply. Photos need to be sent. Information such as; Does is it work? Does it come with battery and charger? What voltage is it? 6v, 12v, 24v ect When purchasing parts, all sales are final, no returns, shipping does include time and materials. Invoices left unpaid for 72 hours are pulled. Any shortage, damage part must be reported within 24 hours. We ship parts within 24 hours of payment or the shipping is free,unless its a weekend, holiday and weather permitting. Payments for parts received after 8pm will be processed next business day. When purchasing any electrical parts from K's Kustom's we do include a 30 day limited warranty. Issues or concerns are to be reported to us asap. We will do our best to work with you in resolving any issue that may have occurred. Due to the increase of shipping at the USPS we have had to increase our shipping cost also, please be advised. Service & Repair Procedures In order for us to provide the best service and quickest turn around time we need to know all prior work that has been done to the unit. We ask that you submit a Service Ticket via our website to provide us with the information. We charge an hourly fee plus parts to Service and Repair your ride-on. We require payment to be paid upon dropping off the ride-on. Additional time and parts on hand will be paid upon pick up of unit. All work will be approved by the client before proceeding with service or repair. The hourly fee for a 6v is $25, a 12v is $35 and a 24v is $45 If a part is not on hand and needs to be ordered, we require that at 100% of the cost of the parts be paid prior to ordering. Once Service & Repair is completed the client will be notified. The client then has a day (24 hours) to pay and pick up said ride-on. If the client does not pick up with in the 24 hour window we, K's Kustom's, will charge a $10.00 dollar a day storage fee, which will be added to the total bill and paid for before receiving their ride-on back. We do not take trade-ins as payment of Service & Repair. K'S KUSTOMS’ LIMITED SALES WARRANTY IMPORTANT: PLEASE READ THIS WARRANTY CAREFULLY BEFORE PURCHASE. This Limited Sales Warranty ("Warranty") is provided by K's Kustoms’ ("K's Kustoms’" or "Warrantor") to the original purchaser ("Purchaser") of any eligible ride-on unit and/or battery sold by K's Kustoms’. This Warranty gives the Purchaser specific legal rights. K's Kustoms’ reserves the right to inspect any product before determining warranty eligibility. WARRANTY PERIODS: a. Ride-On Unit: K's Kustoms’ provides a free thirty (30) day limited warranty on all ride-on units sold, effective from the date of purchase. b. Battery: K's Kustoms’ provides a sixty (60) day limited warranty on batteries, whether purchased with a ride-on unit or separately, effective from the date of purchase. WHAT IS COVERED: This warranty covers defects in materials and workmanship under normal use and service during the applicable warranty period. K's Kustoms’ performs its own testing to ensure units are working correctly before sale. WHAT IS NOT COVERED (EXCLUSIONS): This warranty does not cover damage or failure resulting from: a. Unreasonable use, neglect, accident, abuse, misuse, or improper service. b. Exposure to weather, including rain, snow, or extreme temperatures. Units must be stored in a dry, covered location. Any evidence of water intrusion or rust resulting from improper storage will not be covered. c. Radios, sound systems, or any other add-ons installed on the unit. This warranty covers the parts essential for the unit's operation, not accessories. d. Any attempt at consumer repair, modification of the unit, or servicing by another technician or third party. K's Kustoms’ is not responsible for, and this warranty does not cover, any damage or failure caused by such unauthorized actions. Installation of aftermarket parts, upgraded electronics, modified wiring, non-original batteries, controllers, motors, or accessories voids this warranty unless performed or approved in writing by K's Kustoms’. e. Battery issues arising from failure to follow manufacturer's charging instructions, improper storage below 35 degrees Fahrenheit, charging longer than 30 hours, or tampering with the battery (e.g., removing tape). Adults should periodically examine the battery and charger for damage. CUSTOMER OBLIGATIONS AND CLAIM PROCESS: a. Immediate Notice: The Purchaser must contact K's Kustoms’ immediately (24 to 48 hours) upon discovery of an issue with the unit or battery. Failure to provide timely notice, or continued use of the unit after a defect is discovered,. may result in denial of warranty coverage to the extent the delay prevented proper diagnosis or caused additional damage. b. Return for Service: i. Ride-On Unit: Following immediate notice, the Purchaser shall return the ride-on unit for service and diagnosis within three (3) calendar days, or within another reasonable time approved by K's Kustoms’. ii. Battery: Following immediate notice, the Purchaser has twenty-four (24) hours to bring the battery back to the K's Kustoms’ shop for evaluation or within another reasonable time approved by K's Kustoms’. c. Explanation of Issue: Upon drop-off, the Purchaser must provide a detailed explanation of the issue, including any noises, charging problems, or other relevant details to assist in prompt diagnosis. d. Mobile Service: Mobile service is not included in this warranty. If mobile service is requested, the Mobile Service Fee must be paid before the scheduled appointment. Transportation of the unit to and from K's Kustoms’ is the responsibility of the Purchaser. REMEDY: For covered issues, K's Kustoms’ will, at its option, repair or replace defective covered components or replace the battery during the applicable warranty period. Labor for covered issues is free. This warranty covers only those parts determined by K's Kustoms’ to have failed due to defects in materials or workmanship. If inspection determines the reported condition is not covered by this Limited Warranty, standard diagnostic and repair charges shall apply ($25 for 6v, $35 for 12v and $45 for 24v). If parts must be ordered, K's Kustoms will endeavor to complete the repair as soon as possible, acknowledging that part availability may cause delays. DISCRETIONARY WAIVER: Any flexibility or extension of time windows granted by K's Kustoms’ is at its sole discretion and shall be based on the Purchaser's timely communication and circumstances (such as travel distance). A waiver of any term in one instance does not constitute a permanent waiver of that term or any other term of this warranty. DISCLAIMER OF IMPLIED WARRANTIES: TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES, AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. K'S KUSTOMS’ SPECIFICALLY DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. LIMITATION OF LIABILITY: K's Kustoms’ shall not be liable for any incidental, indirect, special, or consequential damages, including but not limited to loss of profits, revenue, or use, arising from any breach of warranty or condition, or under any other legal theory, even if K's Kustoms’ has been advised of the possibility of such damages. No employee, representative, or agent of K's Kustoms’ is authorized to modify, extend, or create any warranty not contained in this written Limited Warranty unless made in writing and signed by K's Kustoms’. This Limited Warranty is non-transferable and applies only to the original purchaser identified on the sales receipt. Many products sold by K's Kustoms’ are pre-owned, refurbished, or customized. This Limited Warranty applies only to the specific defects and time periods described herein and is not intended to provide coverage equivalent to a manufacturer's new-product warranty. This Limited Service and Repair Warranty is provided by K's Kustoms’ ("Warrantor") to the customer ("Customer") for specific repair or maintenance services performed on a ride-on unit owned by the Customer. K's Kustoms’ reserves the right to inspect the ride-on unit before determining warranty eligibility. 1. WARRANTY PERIOD K's Kustoms’ provides a thirty (30) day limited warranty on labor and covered parts, effective on the date K's Kustoms’ notifies the Customer that the unit is complete and ready for pickup. 2. SCOPE OF COVERAGE This warranty applies solely to the specific repairs, replacement parts, and labor identified on the Customer's invoice or service receipt. No other systems or components of the ride-on unit are covered. Labor: Labor is provided at no cost during the warranty period if, and only if, the issue is the exact same problem previously addressed by K's Kustoms’. Parts: Replacement parts installed by K's Kustoms’ are covered only to the extent they are defective in materials or workmanship, subject to the exclusions below. The performance of a repair does not constitute an inspection or certification of the overall condition, safety, or reliability of the ride-on unit unless expressly stated in writing. 3. WHAT IS NOT COVERED (EXCLUSIONS) This warranty does not cover: New Issues: Any mechanical or electrical problem not specifically addressed during the original service visit. Misuse and Neglect: Damage caused by unreasonable use, accidents, abuse, or improper storage. Weather Exposure: Damage resulting from exposure to rain, snow, or extreme temperatures. Units must be stored in a dry, covered location. This warranty does not cover damage resulting from water intrusion, corrosion, or rust caused by improper storage or exposure to the elements. Continued Use: Damage caused by continuing to operate the unit after a fault or unusual noise is discovered. Unauthorized Repairs: Any attempt at consumer repair, modification, or servicing by a third-party technician after the K's Kustoms’ service visit. Accessories: Radios, sound systems, lights, or other non-essential add-ons. 4. SERVICE FEES AND DIAGNOSIS New Issue Fee: If a unit is returned and the problem is determined to be a new issue not previously addressed, a Service and Diagnosis fee shall be due. ($25 for 6v, $35 for 12v and $45 for 24v) Mobile Service: Mobile service is not included. If the Customer requires K's Kustoms’ to travel to their location, the standard Mobile Service Fee must be paid before appointment. 5. WARRANTY CLAIM PROCESS Immediate Notice: The Customer must contact K's Kustoms’ within forty-eight (48) hours after discovering the recurring issue. Return Window: Following notice, the Customer has three (3) calendar days to bring the unit back to the K's Kustoms’ shop for evaluation or within another reasonable time approved by K's Kustoms’. Duty to Mitigate: The Customer shall discontinue use of the unit upon discovering a recurring issue that could reasonably cause additional damage. Continued operation may result in denial of warranty coverage for any resulting damage. 6. MODIFIED UNITS For units previously modified by K's Kustoms’, this warranty includes the first Diagnostic and Service for free if the issue relates to the modification. Subsequent issues or unrelated repairs will be subject to standard service fees. Unless otherwise stated in writing, aftermarket or custom components installed as part of a modification are not covered by this warranty beyond the initial diagnostic evaluation described above. 7. DISCRETIONARY WAIVER Any flexibility regarding return windows is at the sole discretion of K's Kustoms’ and is based on the Customer's timely communication and specific circumstances, such as travel distance. 8. LIMITATION OF LIABILITY AND GOVERNING LAW K's Kustoms’ shall not be liable for incidental, indirect, special, or consequential damages, including loss of use, revenue, or other economic losses arising from the service performed. This warranty is governed by the laws of the State of Rhode Island. Any legal action shall be filed exclusively in the courts of competent jurisdiction within the State of Rhode Island. Ride-on units presented for service are often used products with varying age, wear, previous repairs, or modifications. K's Kustoms’ is not responsible for pre-existing conditions or latent defects unrelated to the specific repair performed. Except for the express limited warranty provided herein, K's Kustoms’ disclaims all other express or implied warranties to the maximum extent permitted by applicable law. PROPER CARE IS REQUIRED TO MAINTAIN COVERAGE. This SLA Battery Warranty is provided by K's Kustoms’ to the original purchaser of an SLA battery, whether purchased as part of a ride-on unit or as a standalone component. 1. LIMITED WARRANTY PERIOD K's Kustoms’ provides a sixty (60) day limited warranty from the date of purchase. During this period, K's Kustoms’ will replace the SLA battery one (1) time if a manufacturing defect is confirmed. Any replacement battery provided under this warranty does not restart or extend the original sixty (60) day warranty period. K's Kustoms’ reserves the right to inspect and test any battery before determining warranty eligibility. 2. PURCHASER'S PRIMARY RESPONSIBILITY The useful life and performance of an SLA battery depend significantly on proper charging, storage, and maintenance by the Purchaser. It is the sole responsibility of the Purchaser to understand, maintain, and care for the SLA battery in accordance with the specific manufacturer's specifications. K's Kustoms’ provides the following information as guidance only. In the event of a conflict, the manufacturer's official specifications shall control. 3. GENERAL SLA BATTERY MAINTENANCE GUIDANCE Failure to adhere to the manufacturer's maintenance recommendations may result in denial of warranty coverage where such failure contributed to the battery's damage or failure. Manufacturer Specs: Purchaser is advised to consult the specific manual for their battery model. Those specifications supersede any general guidance provided herein. Full Charge Requirement: Many SLA battery manufacturers recommend approximately 14–18 hours for a full charge of a 12-volt and 24-volt SLA battery and approximately 6–12 hours for a 6-volt SLA battery, depending on battery capacity and charger output. Always follow the battery manufacturer's recommendations. Periodic Maintenance: SLA batteries must be charged at least once every thirty (30) days, regardless of use, to prevent "deep discharge" or sulfation, which permanently damages the cells. Overcharge Prevention: Do not exceed thirty (30) hours of continuous charging. Overcharging causes thermal damage and "gassing" not covered by this warranty. Environmental Responsibility: SLA batteries must be stored in a climate-controlled environment (above 35 degrees Fahrenheit). Damage from freezing or outdoor storage is considered purchaser neglect. Because battery condition depends heavily on charging practices, storage conditions, frequency of use, and environmental factors beyond K's Kustoms' control, battery life cannot be guaranteed. 4. EXCLUSIONS FROM COVERAGE This warranty does not cover: Tampering: Any removal of tape, opening of the casing, or modification of wiring. Physical Damage: Cracked casings, leaked acid, or charred terminals. Blown Fuses: If the unit stops working, check the external fuse (recommended 35-amp). A blown fuse is a safety feature and is not a battery defect. Neglect: Batteries left uncharged for more than 30 days or stored in temperatures below 35 degrees Fahrenheit. Improper Installation or Electrical Misuse: Damage resulting from improper installation, reverse polarity connections, short circuits, or use of the battery in an application for which it was not intended. Incorrect Charging Equipment: Damage caused by the use of an incorrect, incompatible, modified, or defective battery charger or charging system. 5. WARRANTY CLAIM PROCESS Immediate Notice: Purchaser must contact K's Kustoms’ within twenty-four (24) hours of discovering a battery issue. Physical Return: The battery must be returned to the shop for testing within forty-eight (48) hours of notice. Testing Period: K's Kustoms may perform charging, voltage, and load testing, which may require up to twenty-four (24) hours or longer depending on the condition of the battery. 6. DISCRETIONARY WAIVER Any flexibility regarding return deadlines is at the sole discretion of K's Kustoms’ and is primarily granted to customers traveling long distances who maintain timely communication. 7. LIMITATION OF LIABILITY AND GOVERNING LAW This warranty is governed by the laws of the State of Rhode Island. Any legal action shall be filed exclusively in the courts of competent jurisdiction within the State of Rhode Island. K's Kustoms shall not be liable for incidental, indirect, special, or consequential damages arising from the use or failure of the battery or from any breach of this Limited Warranty, to the extent permitted by applicable law. 8. K'S KUSTOM'S SHIPPING ISSUES AND RETURNS Once an item is shipped out it is no longer in our control. We ship USPS Priority Mail with an average delivery time of 3-5 days. And Greyhound Package Express for oversized items such as ride-ons with a average delivery of 14 days. Shipping through the USPS Priority Mail provides tracking and insurance. You are able to see where your part is in transit. And if lost or damaged we are able to file a claim. Shipping through Greyhound Package Express provides tracking and insurance also. Please be advised that we do add a surcharge for packaging and travel. If a refund is needed due to lost or damage parts the refund will be what the cost of shipping and part minus our additional fees. Refunds are not paid until the claim is paid by either the USPS or Greyhound Package Express. At anytime you are concerned about a part not arriving, please contact us as soon as possible so we may follow up with the shipper and try and resolve the issue in a timely manner.
